i'm joined by cnn's legal analy analyst jeffrey toobin. we're talking about marijuana for recreational purposes. there's a big difference. >> it is. and the governor is quite clear and right. it is not legal under federal law to possess marijuana. now, what makes this a peculiar situation is that in most jurisdictions when i was assistant u.s. attorney in new york, we had rules. we didn't prosecute under federal except very large quantities of marijuana. we left that to the states. here, apparently, the state is not going to prosecute. but even though the federal government doesn't generally prosecute, it's still illegal. so obviously there has to be some sort of negotiation here or people are taking a terrible risk. >> so what's the next legal step? the folks in colorado think that they're going to be able to go buy marijuana and use it for fun, whatever, and the federal government says not so fast. >> right. when the federal government government -- the obama administration has been quite clear that they are going to enforce federal law.

cnn has learned from two u.s. officials that paula broadwell's security clearance has been suspended. she is a serving reservist, if you will, with the u.s. army, a military intelligence analyst. as such, she would at least have a secret level security clearance. we are now told that security clearance suspended pending the outcome of several investigations. we went to the army to ask them for an official response. they will not say anything except the following. and let me read it to you. "appropriate actions with regard to this officer's clearance and access have been taken." the statement goes onto say "the army has been cooperating with federal law enforcement authorities in this matter. and those actions are ongoing." wolf, you will recall a couple of days ago the fbi went to broadwell's home. we all saw the video of fbi agents taking away boxes of material, computers. the discussion centering around what kind of classified information she might have had in her home. when someone with a security clearance has

cnn's martin savidge joins us from cleveland. early voting, martin, very important for the president. how's it looking where you are in cleveland right now? >> reporter: well, at least the cnn poll of the early voters seem to be going very much in president obama's favor. let me point out something here. the early voting has finally come to an end in the state of ohio. the reason i say finally is it began october 2nd. it ended at 2:00 this afternoon. the complete tallies for the state are not up. but up until friday, 1.6 million early votes were cast. of that, 1.1 million were absentee ballots. in cuyahoga county, 282,589 votes were cast. here's the number that could end up haunting the state. 1.3 million absentee ballots were sent out. so far, 1.1 million have come back. 200,000 absentee ballots still out there somewhere. the worry is that many of those ballots could actually be people who show up to vote on election day. they can do that but they'll be given a provisional ballot. we already know there's a lot of legal wrangling

cnn's brian todd is on the island. he's joining us live. brian, tell us what's going on. >> reporter: wolf, we're in the new dorf beach section cedar grove avenue. this place is still flooded out even after the waters receded. people just barely able to kind of wade through the water, try to get to homes and assess damage. you've got a church that's flooded out here to your left, my right. and our photo journalist can pan back over this way down marine way. look down here with just the debris and people trying to gather things and bring things out and clear their homes of all the wreckage. what we know now, wolf, is that the bodies of two young boys who were washed away from their mother during the storm have been found. they were found in a marsh not too far away from here. now, that brings the death toll we think to a little bit more than the dozen people that we knew of before. exact numbers i don't have. but it's more than a dozen now just on staten island were killed by this. hundreds of homes have been damaged or completely destroyed.
